These general conditions of sale regulate the purchase of products made online via the website www.chocolate-shop.it.it. The products purchased on www.chocolate-shop.it.it are sold directly by Kynetos Srl, hereinafter referred to as the "Seller".
Kynetos Srl is a company registered in the Company Register of Forlì, CF and VAT number 03544820404, registered office in Via E. De Amicis, 4/D - 47121 - Forlì (FC), share capital Euro 100,000.00 int. vers.

1. Our trade policy

The Seller offers the products for sale on www.chocolate-shop.it.it and carries out its e-commerce activity exclusively towards its end users, consumers, professionals and legal entities.

1.2
These General Conditions of Sale exclusively regulate the offer, sending and acceptance of orders between users of www.chocolate-shop.it.it and the Seller.


2. How to conclude the contract with the Seller
2.1
To conclude the purchase contract for one or more products on www.chocolate-shop.it.it, you will have to complete the order form in electronic format and send it to the Seller, electronically, following the relevant instructions.

The order form contains a summary of information on the essential characteristics of each product ordered and the related price (including all applicable taxes or duties), the payment methods that you can use to purchase each product and the delivery methods of the products purchased, shipping and delivery costs, the conditions for exercising the right of withdrawal and the methods and times for returning the purchased goods.

The contract is concluded upon receipt by the Seller, electronically, of the order form, after verifying the correctness of the data relating to the order itself.

The order form will be archived in our database for the period of time necessary to process the orders and in any case within the terms of the law. You will be able to view your order form by logging in with your codes in the reserved area.

The Seller may not process your purchase orders that do not provide sufficient guarantees of solvency or that are incomplete or incorrect or in the event of unavailability of the products. In these cases, we will inform you by email that the contract is not concluded and that the Seller has not processed your purchase order, specifying the reasons. If the products presented on www.chocolate-shop.it.it are no longer available or on sale at the time of your last access to the site or sending the order form, it will be the Seller's responsibility to notify you within thirty (30 ) days starting from the day following the day on which you have sent your order to the Seller, any unavailability of the products ordered. In case of forwarding the order form and paying the price, the Seller will refund the amount already paid by you.

By electronically transmitting the order form, you unconditionally accept and undertake to observe, in relations with the Seller, the aforementioned General Conditions of Sale. If you do not agree with some of the terms set out in the General Conditions of Sale, we invite you not to submit the order form for the purchase of products on www.chocolate-shop.it.it.

By submitting the order form you confirm that you know and accept the General Conditions of Sale and the further information contained in www.chocolate-shop.it.it, also referred to via links, including the General Conditions of Use , the Privacy Policy and the Information on the Right of Withdrawal.

Once the contract is concluded, the Seller will send you, by email, a receipt of the purchase order, containing a summary of the information already contained in the order form.


3. Guarantees and indication of product prices

The essential characteristics of the products are presented on www.chocolate-shop.it.it within each product sheet. However, the images and colors of the products offered for sale on www.chocolate-shop.it.it may not correspond to the real ones due to the Internet browser and monitor used.

3.2
The Seller does not sell used, irregular or lower quality products than the corresponding standards offered on the market.

3.3
The Seller, in the event of exercising your right of withdrawal, has the right not to accept the return of products that have been altered in their essential and qualitative characteristics or that have been damaged.

3.4
Product prices may vary. Check the final sales price before submitting the relevant order form.

3.5
Purchase requests from countries not present among those on the country selection page cannot be accepted by the Seller.


4. Payments
4.1
The prices displayed include VAT, packaging and packaging.

4.2
To pay the price of the products and the related shipping costs you can follow one of the methods indicated in the order form.

In case of payment by credit card, the financial information (for example, the credit/debit card number or its expiry date) will be forwarded, via encrypted protocol, to Banca Sella or other banks, which provide the relevant remote electronic payment services, without third parties being able to have access to them in any way.

7. Right of withdrawal
7.1
You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) working days, from the day of receipt of the products purchased on www.chocolate-shop.it.it, giving notice to the Salesperson.

7.2
To withdraw from the contract you will have to specify the products purchased, the relevant order number, your identification data and the bank details (holder and number of C/C, ABI, CAB, CIN) for the refund of the amount paid for the purchase of products. You must return the products to the Seller who must receive them within fourteen (14) working days from when you received the products.

7.3
Shipping costs for the original delivery of the purchased products will not be refunded. Return shipping, however, is free if you decide to use our courier. If you decide to use a different courier, the return shipping costs will be your responsibility.

7.4
The right of withdrawal is however subject, in addition to the conditions specified in the previous points, also to the following conditions:

• The consignment note must be correctly completed
• The right of withdrawal applies only to goods intact at the time of return;
• The products must not have been used, modified or damaged;
• The products must be returned in a single shipment to the Seller;
• Products must be returned in their original packaging;
• The Seller must receive the returned products within fourteen (14) working days from the date of delivery of the order.

7.5
In the event that the withdrawal is exercised in accordance with the conditions set out above, the Seller will reimburse the customer the entire sum collected for the purchase of the products, within 14 days from the date on which the Seller became aware of the exercise. of your right of withdrawal.

7.6
If the methods and terms for exercising the right of withdrawal are not respected, you will not be entitled to a refund of the sums already paid to the Seller; however, you will be able to regain, at your expense, the products in the condition in which they were returned to the Seller. Otherwise, the Seller may retain the products, in addition to the sums already paid for their purchase.


8. Refund times and methods

After returning the products, the Seller will carry out the necessary checks relating to their conformity with the conditions and terms indicated in paragraph 7. In the event that the checks are concluded positively, the Seller will send you, via e-mail, the relevant confirmation of the acceptance of returned products.

10. Age Requirements
10.1
The sale of alcoholic products is prohibited to minors. By purchasing any alcoholic product you declare that you are of age as per art. 7 of Legislative Decree 158/2012. Chocolate Shop assumes no responsibility in the event of purchases made by minors under 18 who have declared that they are of a different age.


11. Applicable law and dispute resolution

The General Conditions of Sale are governed by Italian law and in particular by legislative decree 6 September 2005 n. 206, on the consumer code in Chapter I "Consumer rights in contracts", with specific reference to the legislation on distance contracts and the legislative decree of 9 April 2003 n. 70 on certain aspects concerning electronic commerce .

In the event of disputes between the Seller and each user, arising from the General Conditions of Sale, we inform you that the European Commission provides a platform for the alternative extra-judicial resolution of disputes, accessible on the website https://ec.europa.eu/ odr .


12. Modification and updating

The General Conditions of Sale are modified from time to time also in consideration of any changes to legislative regulations. The new General Conditions of Sale will be effective from the date of publication on www.chocolate-shop.it.it.
